Decision: At the conclusion of Race 10, the Macaulay Motors and Pub Charity 1850, under Rule 871 (1) (d) an information was lodged by Stipendiary Steward Mr S Ching alleging that Mr D Bradley, riding LAUTENSCHLAGER, allowed his mount to shift outwards

At the conclusion of Race 10, the Macaulay Motors and Pub Charity 1850, under Rule 871 (1) (d) an information was lodged by Stipendiary Steward Mr S Ching alleging that Mr D Bradley, riding LAUTENSCHLAGER, allowed his mount to shift outwards when not clear of WINDVALE JO, causing that horse to check and inconveniencing PRINCE DANCE and TUTUSAFORE near the 100 metres.

Mr Ching used the head-on and side-on video clips to highlight the alleged interference.  Mr Ching stated that Mr Bradley was travelling behind RUSSIAN DIVA, ridden by J Bates, and then moved out forcing WINDVALE JO, ridden by C Johnson, to take hold and steady his horse, who then moved out onto TUTSAFORE inconveniencing this horse.

Mr Bradley stated that it was his first ride on the horse and that following the race he suggested to the trainer, Mr Henry, that because of the horse’s racing manners he should try side winkers or head gear.  Mr Bradley also said that the horse raced with its head on the side, felt full of running but was not giving.  Mr Bradley maintained the horse was at fault for moving out and that he straightened the horse by hitting it on the right shoulder.  Mr Bradley also stated the horse was a sook and that the moving out happened in just two strides.  Mr Bradley stated that there were mitigating circumstances in his opinion.

Mr Ching stated that it was hard to support Mr Bradley’s case after viewing the films.  Mr Ching stated that Mr Bradley had ridden his horse into the gap, shifting ground at the same time.

Mr Bradley was found guilty of the breach and, in fixing penalty the following points were considered :

--

1.         Mr Bradley’s outstanding riding record over the past 12 months (1 suspension).

--

 

--

2.         Mr Bradley being a senior jockey and regularly riding in both the North and the South Island.

--

 

--

3.         Mr Bradley’s professional conduct throughout the hearing.

--

 

--

Mr Bradley elected to defer penalty under the 7 day rule, due to his up and coming riding engagements.

--

Mr Bradley was suspended from the conclusion of racing on 30 November 2007 until the conclusion of racing on 5 December 2007.
