Mr Bishop admitted the breach and thus the committee find the charge proved.

Penalty:

The committee believed a suspension with a starting point of six riding days was appropriate and took into account the migrating factors as outlined.

Mr Bishop is suspended from the conclusion of racing on the 23rd November 2012 up to and including the 29 November 2012, a period of five riding days.

Charge:

The rule reads: 

636 (1) (c):

A person being the rider of a horse in a race must ride his horse out to the end of the race if there is a reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared. 

Facts:

At the conclusion of race one, Stipendiary Steward Mr M Davidson filed information 5893, alleging that senior jockey Mr Ryan Bishop relaxed his ride on Robert Brooke over the concluding stages and was beaten for fourth by half a head.

Mr Bishop admitted the breach.

Stipendiary Steward Mr J McLaughlin used the video clip to highlight the alleged incident, stating that Mr Bishop relaxed his ride about three strides from the winning post.

Mr Bishop confirmed Mr McLaughlin’s observation, stating that he had simply made an error of judgement. 

Mr Bishop admitted the breach and thus the committee find the charge proved.

Submissions for Penalty:

Stipendiary Steward Mr Davidson told the committee that Mr Bishop had no previous breaches under this rule in the past twelve months. Mr Davidson recommended a range of penalties, from a fine at the high end of between $400 and $600, or a suspension of five or six riding days. Mr Davidson was aware that Mr Bishop had ridden recently at Woodville on the 19th November 2012 and was possibly riding at Taranaki on the 23 November 2012.

Mr Bishop stated that he had recently returned to race riding and was not in a financial position to pay a substantial fine. He said he had eight rides at today’s meeting but averaged five or six rides every meeting.

In fixing penalty the committee took into account the following factors:

·         Mr Bishop's early admission of the breach.

·         Mr Bishop's excellent riding record over the past twelve months which showed no breaches of this rule.

·         The committee believed the breach was mid range and noted the difference in stake money between fourth and fifth placing being $175.00.
