Mr J Chong is suspended for two South Island riding days from the close of racing on Wednesday, 20 November 2013 until the close of racing on Sunday, 1 December 2013.
Facts:
Following the running of race 6, the Bayswater Feed Maiden, Information A5790 was filed by Stipendiary Steward, Mr M Davidson under rule 638(1)(d). The Information stated that Apprentice Jockey, Mr J Chong SWEET BUT NEAT allowed his mount to shift inwards over the concluding stages causing VOUSSOIR (K Walters) to be checked.
Mr Chong admitted the breach and confirmed that he understood the rule under which he was charged.
Rule 638(1)(d) stated a rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Stipendiary Steward, Mr J McLaughlin used the head on and side on films of the alleged incident highlighting SWEET BUT NEAT (J Chong) moving inwards approximately five lengths from the winning post causing VOUSSOIR (K Walters) to be taken a hold of, and be checked.
Mr Chong stated that he had ridden the horse on several occasions and it had a tendency to run around.
Mr Davidson supported Mr Chong’s statement that the horse was difficult to ride.

Mr Davidson stated that the breach was at the low end of the scale, and that it was unfortunate that Mr Chong had not taken some action when the horse ducked in.
Mr Davidson stated that Mr Chong had an outstanding riding record having ridden in 193 races, 24 this season and not had a breach of any rule throughout this time.
Mr Hamilton asked the JCA to consider Mr Chong’s admittance of the breach, and his outstanding riding record when fixing penalty.

The JCA was satisfied a clear breach of the rule had occurred. The head on and side on film clearly shows SWEET BUT NEAT ridden by Mr J Chong ducking inwards causing VOUSSOIR to be checked.
In fixing penalty I have taken into account Mr Chong’s early admittance of the breach, also his outstanding riding record and the fact that the breach was at the low end of the scale.
