Winton JC 19 November 2010 – R 4
ID: JCA12822
Code:
Thoroughbred
Meet Title:
Winton JC - 19 November 2010
Meet Chair:
ADennis
Meet Committee Member 1:
NSkelt
Race Date:
2010/11/19
Race Number:
R 4
Decision:
After taking into account all the evidence presented, the Committee was satisfied that interference did indeed take place and the charge is upheld. Clearly Aparima Dan ridden by Mr Stackhouse has moved inwards when not sufficiently clear taking Rodeo Queens line, causing that horse to be checked.
Penalty:
Mr Stackhouse, when informed of the Committee’s decision chose to take advantage of the 7 day rule. Therefore the riding suspension for Mr Stackhouse will commence at the conclusion of racing on 26 November and continue until the conclusion of racing on December 3 2010.
The Committee reminded Mr Stackhouse of his professional duty, and related to him the seriousness of these offences, their frequency, and that he should consider seeking some professional advice from those associated with his welfare as a successful apprentice.
Charge:
Careless riding
Facts:
At the conclusion of Race 4, the Central Southland Lodge, Nind Electrical and Southern Stock Maiden, an information 7296 was lodged by Stipendiary Steward Mr J McLaughlin under Rule 638(1)(d) alleging that D Stackhouse, rider of Aparima Dan permitted his mount to shift inwards near the 200m , causing tightening to Rodeo Queen for some distance. Rodeo Queen had to check out of its rightful running.
The rule reads 638(1)(d) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be: (b) reckless
Mr Stackhouse admitted the breach and wished to be present at the hearing.
Facts:
Stipendiary Steward Mr Davidson showed the Committee several video clips of the alleged incident showing Mr Stackhouse moving his mount inwards across the front of Mr Bishop’s mount Rodeo Queen at approx the 200m mark. Mr Davidson stated that in the opinion of the Stewards there was insufficient space for the inward movement and that Mr Bishops mount was severely checked., Mr Davidson also stated that at this time Mr Stackhouse also used his whip 3-4 times and that this action had compounded the problem. Mr Davidson also stated that it was his belief that Mr Bishops mount, Rodeo Queen had not contributed to the incident by any outward movement.
Submissions for Decision:
Mr Stackhouse said that in his opinion his mount maintained a reasonably straight line and that Mr Bishop had ample space to ride his horse out.
Mr Prince supported this comment by asking the question ”Why did Mr Bishop stop riding?" Mr Prince maintained that there was ample room and that Mr Bishop chose to stop riding.
Mr Stackhouse also stated that his horse was green.
In summary, Mr McLaughlin repeated that Mr Stackhouse had dictated Mr Bishop’s line, and that Mr Stackhouse had shown little concern by the inward crowding that he had caused, and that his use of the whip at this stage had added to the problem.
Submissions for Penalty:
Mr McLaughlin presented Mr Stackhouse’s relevant riding record over the past 12 months. There were in fact 5 previous cases of infringement of rule 638(1((d)
They were
3 January Central Otago - 2 Days
16 May Winton - 3 Days
4 July Waimate - 3 Days
12 September Timaru - 4 Days
20 October Te Aroha - 4 Days
Mr McLaughlin stated that the Stipendiary Stewards felt that this offence was at the middle to lower end of the scale.
Reasons for Penalty:
The Committee, having considered all the evidence presented, the riders admittance of the breach, the previous riding record and penalties imposed recently for similar offences, agreed that a five (5) day suspension was appropriate.
