Accordingly, a suspension is imposed on Mr Prastiyou which will commence at the conclusion of racing on Wednesday, 18 September and conclude after racing on Friday, 27 September 2013 (2 South Island riding days).
Charge:
Following race 5 The Vincent Langford Memorial/Linton Contract Maiden an Information (5785) was filed pursuant to rule 638(1)(d).
The informant Stipendiary Steward, Mr M Davidson, alleged that Mr Prastiyou hit his mount MISS CATTLECREEK with the whip in his left hand crowding and unbalancing I’M EMPTY (S Muniandy) passing the 200 metre mark.
Mr Prastiyou acknowledged he understood the nature of the charge and rule.
Rule 638(1)(d) provides – A rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Facts:
Stipendiary Steward, Mr Zarb used the video clip to highlight Mr Prastiyou hitting his mount with his whip in the left hand causing his horse MISS CATTLECREEK to move outwards onto I’M EMPTY crowding him to become unbalanced.
Mr Winsloe representing Mr Prastiyou, stated that MISS CATTLECREEK whom he trains was a difficult horse to ride and has a tendency to run about, and at his last start he attempted to run off.
Mr Davidson did not dispute the statement.
Mr Winsloe acknowledged that Mr Prastiyou had made an error by using his whip in his left hand and had not reacted quickly enough.
Submissions for Penalty:
Mr Davidson produced Mr Prastiyou’s record, which showed two previous breaches under this rule in the past twelve months, - 30/10/12 at South Canterbury (2 days) and 28/6/2013 at Waimate (2 days).
Mr Davidson stated that Mr Prastiyou was a busy, successful apprentice jockey, and admitted the breach at the first opportunity, which he should be given some credit for.
Mr Davidson stated that he assessed the carelessness at the low end of the range.
Mr Prastiyou said he had four to five rides on most race days.
Reasons for Penalty:
All of the evidence and submissions were carefully considered.
The early admittance of the breach, and the fact that the breach was at the very low end of the scale were compelling factors in fixing penalty. It was also accepted that MISS CATTLECREEK was a difficult horse to ride.
The fact there had been two previous breaches under the rule in the past twelve months was also carefully considered, with one of those breaches being eleven months ago. After taking into account all the above factors I consider an appropriate penalty is a 2 day suspension.
