--Mr Khairil admitted the breach, and Trainer John McKay assisted Mr Khairil throughout the hearing.
--Stipendiary Steward Mr Davidson showed several video clips of the alleged incident, highlighting the gesture, and the altered body position of Mr Khairil prior to the winning post.
--Stipendiary Steward Mr Ching endorsed Mr Davidson’s observations, stating also he had concerns around the safety aspect surrounding the gesture.
--Mr McKay stated that Mr Khairil had made an error of judgement, and that he had been given an opportunity by JUST RHYTHM’s Trainer, Mr K Thompson, and was keen to reward him for his support.

--In fixing penalty, the Committee took into account Mr Khairil’s guilty plea, and the level of the winning stake of the race.
--Mr Khairil was fined the sum of $400.00 and reminded of his professional obligations and the safety aspect surrounding his action.
