Decision: An information was lodged by Stipendiary Steward Mr S Ching under Rule 866 (1) (c) alleging that Miss C Spittles failed to ride her mount MISTER JAKE out to the finish
An information was lodged by Stipendiary Steward Mr S Ching under Rule 866 (1) (c) alleging that Miss C Spittles failed to ride her mount MISTER JAKE out to the finish and got beaten for 5th place, the official margin being a nose, the fifth stakes bearing place totalling $225.00.
--Miss Spittles did not admit the breach and was assisted by a trainer, Mr John McKay, throughout the hearing.
--Stipendiary Steward Mr Davidson showed several video clips of the alleged incident, highlighting in his opinion Miss Spittles taking hold of her mount MISTER JAKE, changing ground, then with about three strides prior to the winning post, making no effort to ride her mount out.
--Mr Ching endorsed Mr Davidson’s observations and comments, stating that the three strides prior to the winning post were critical.
--Mr Davidson also made comment regarding Miss Spittles’ body position.
--Mr McKay emphasized that MISTER JAKE had to change ground, and was hanging out, and was only battling over the final phase of the race. He also stated that Miss Spittles had been warned previously about keeping her mount straight, and was being very cautious, as a result of the warning.
--Miss Spittles reinforced that in her opinion MISTER JAKE was only battling halfway down the straight.

DECISION
--Clearly in the Committee’s opinion Miss Spittles has made an error of judgement in not riding out her horse MISTER JAKE to the winning post, and as a result a breach of the Rule has occurred and the charge has been upheld.
--In fixing penalty, consideration was given to the 5th placed stake ($225), also to the fact that Miss Spittles has an outstanding riding record. The Committee also believes the horse MISTER JAKE was only battling in the latter part of the race, and the offence was at the lower end of the scale.
--Miss Spittles was fined the sum of $300 and reminded of her professional obligations.
