Under Rule 520 (4) (c) Stipendiary Steward Mr S Ching alleged that Mr P Holmes failed to make the contract weight for TAPILFLY in that he was 1 kilogram over and was replaced by C Anderson.

--Mr Holmes admitted the breach and chose to be present at the hearing.
--Mr Ching explained that Mr Holmes, on arriving on the course, had weighed out a kilogram above the carded weight of 54 kg for the horse TAPILFLY in race 1. Mr Ching said he was aware of potential weight issues for Mr Holmes as a result of discussions between the two at the recent South Canterbury meeting. Mr Ching expressed his disappointment that he had not been contacted by Mr Holmes prior to the day of the Winton meeting.
--Mr Holmes explained that he had been using the sweat box regularly and with minimal intake of food and liquid and the advent of recent warmer weather he felt he could make the required weight.
--Mr Ching suggested a monetary penalty of between $150 - $250, and Mr Holmes agreed that this range was appropriate.
--Given Mr Holmes’ clean previous record in respect of the excess weight rule, we impose a penalty of $200, and remind Mr Holmes of his future responsibilities.
