As Ms Barnes has admitted the breach, it is found to be proved.

Penalty:

We suspend Ms Barnes’ licence for 6 national riding days. This is from the end of racing on 14 October up to and including 22 October 2018.

Facts:

Mr Davidson alleged that Ms Barnes (MUTUNGA TAP) allowed her mount to shift outwards near the 300 metres causing BOYSLIGHTUP (Mr B Murray) to be checked.

Mr McLaughlin, Stipendiary Steward, demonstrated that on the point of the bend, with Mr Murray improving quickly on her outside, Ms Barnes came out checking Mr Murray. He said Mr Murray had to check off the heels of MUTUNGA TAP.

Ms Barnes accepted she had moved out. It was an error of judgement. Her mount had been under a ride from the 400 metres and had rolled about a bit. When questioned by this Committee, she said she was not aware Mr Murray was there. There was no yelling. She acknowledged she had not looked before she shifted but she emphasised she had not realised at the time the extent to which MUTUNGA TAP had “stepped out”. She had control of the horse and was not looking to move out.

Mr Davidson acknowledged that Ms Barnes was not aware that she had shifted out. She was surprised when the Stewards questioned her. MUTUNGA TAP had been under a ride and she was unlucky that Mr Murray was improving so quickly.

Submissions for Penalty:

Mr Davidson produced the respondent’s record which evidenced one suspension in the past year, at Riccarton on 5 May last when she was suspended for 6 days.

Mr Davidson said Ms Barnes was a busy rider and that this was a very good record. He believed the breach was low-range. It looked worse than it was. Ms Barnes was on a tiring runner and she was caught out by the speed with which Mr Murray was improving and by the fact there was no room for him to shift out. He believed some 2 strides earlier there had been room for her.

Ms Barnes asked us to take into account she was riding a tiring horse and her good record.

Reasons for Penalty:

Ms Barnes has permitted her horse to shift outwards on the point of the bend. In so doing, she has come into the racing line of Mr Murray who has had to check his mount. We accept that Mr Murray was improving quickly and that, as Mr Davidson has said, Ms Barnes came out at the wrong time. A stride or two earlier, she would not have been in breach of the careless riding rule.

We believe the breach to be low-range, as does Mr Davidson and Ms Barnes. We take a starting point of 6 days and increase this by one day due to the quite severe check that Mr Murray received on a horse that was mounting a run at the time. Ms Barnes’ record is very good. She is a busy rider. We give a day’s credit for record and admission of the breach.
