ID: JCA15758
Code:
Thoroughbred
Meet Title:
Winton JC - 12 October 2014
Meet Chair:
NSkelt
Meet Committee Member 1:
GHall
Race Date:
2014/10/12
Race Number:
R 1
Decision:
Miss Edmeads admitted the breach. The breach is found to be proved.
Penalty:
Miss Edmeads is suspended from the conclusion of racing on Sunday 12th October 2014 until the conclusion of racing on Saturday 25th October 2014. The three days being the Ashburton Racing Club 18th October 2014, Otago Racing Club 23rd October 2014 and the Canterbury Jockey Club 25th October 2014.
Facts:
The rule reads 638(1)
A rider shall not ride a horse in a manner which the Judicial Committee consider to be careless.
At the conclusion of race 1 The Vincent Langford Memorial Chilton Shearing Maiden information A 3872 was lodged by Stipendiary Steward Mr M Davidson alleging that with approximately 900 metres to run Miss A Edmeads (PERIA PRINCESS) shifted ground inwards when insufficiently clear of MIDNIGHT MOCHA (T Direen) with MIDNIGHT MOCHA clipping heels and blundering badly.
Mr Davidson showed the Committee several video clips of the incident, highlighting PERIA PRINCESS (A Edmeads) moving across from the 3 wide position to 2 wide at the point of the turn.
Mr Davidson stated that Miss Edmeads was only a length clear and that Miss Direen’s horse MIDNIGHT MOCHA had clipped heels as a result of the incident.
Miss Edmeads stated that she had made an error of judgement and had come across too soon when not sufficiently clear.
Mr N Harnett (Jockey Mentor) said that the first interference (see earlier decision in “M”) contributed to the incident in that Miss Direen’s horse ended up 1 ½ horse widths off the fence and that Miss Edmeads' inwards movement was not dramatic or quick.
Submissions for Penalty:
Mr Davidson described the incident to be at the mid-range of carelessness and that the consequences of Miss Edmeads’ actions outweighed her culpability.
Mr Davidson stated that Miss Edmeads was returning back to riding after a six month layoff from injury, and that she had no breaches under any rule in her career spanning some 50 rides.
Miss Edmeads stated that it was her first race day ride back after an unblemished record.
Reasons for Penalty:
The breach is mid-range. Miss Edmeads has simply made an error of judgement and we concur with Mr Davidson that the consequence of Miss Edmeads’ actions (Ms Direen’s horse blundering) outweighs her culpability.
The JCA penalty guide recommends a starting point of a 5 day suspension. We have given a one day reduction for the early admission of the breach and a further one day reduction for Miss Edmeads’ unblemished record.
