Facts:
Mr Munro alleged that Mr T Larsen (SASSY’S VC) shifted outwards passing the 1250 metres forcing the outside runner LA ROCCA (Mr A Milne) wider on the track.
Miss Haley demonstrated on the videos that Mr Larsen was racing 4 back on the rails when he shifted out. In so doing, he pushed Mr Milne from 2 to 3-wide on the track. Mr Milne restrained his runner and shifted back in to be on Mr Larsen’s back.
Mr Munro stated that as a consequence of the breach Mr Larsen received a run he should not have, although he may have got the run later. Mr Larsen had finished third in the race. He had received a run one off with cover. Mr Milne on the other hand, had eventually dropped out of the race.
Mr K Larsen agreed that the Respondent had pushed out. He said Mr Milne’s horse had been going rough and had been struggling to keep up. There had been a 3/4 gap for the Respondent. He emphasised that Mr Milne had been able to slot straight back in on to the Respondent’s back and had dropped out of the race from the 500 metres.

Mr Munro produced the Respondent’s record which was clear under this rule. He described Mr Larsen as a Junior Driver who drove primarily in Southland. Mr Larsen has had 91 drives last season and 49 this season. He believed a penalty at the starting point in the Penalty Guide of a $250 fine or a 5-drive suspension was appropriate.
Mr K Larsen reiterated that the breach was low end. Mr Milne’s chances had not been affected.
Reasons for Penalty:
The breach is low end. Mr Milne has eventually dropped out of the race. That said, Mr Larsen has obtained a run to which he was not entitled under the Rules. His record under this rule is very good. There is a $50 reduction for this fact plus his status as a Junior Driver.
