At the conclusion of Race 9, The EIS Electrical Mobile Pace, an information was lodged by Stipendiary Steward Mr CJ Allison under Rule 869(2)(a) alleging that BR Shirley (BEST LEGACY) used his whip excessively over the final stages of the race.

At the conclusion of Race 9, The EIS Electrical Mobile Pace, an information was lodged by Stipendiary Steward Mr CJ Allison under Rule 869(2)(a) alleging that BR Shirley (BEST LEGACY) used his whip excessively over the final stages of the race.

Mr Shirley admitted the breach.

Mr Knowles used a video clip of the incident, highlighting Mr Shirley striking his horse BEST LEGACY twenty two times from the 250 metre mark to the finishing line.

Mr Allison stated that in his opinion the alleged breach of the rule was not improper or undue, just excessive.

--

Mr Shirley stated his horse got up and won the race and that his whip action was not big wallops.

In fixing penalty The Committee took into account submissions from Mr Allison who stated that Mr Shirley was a busy driver who had in the past had some difficulties abiding to this rule, however there had been noticeable improvement in recent times.

It was noted that Mr Shirley had been charged and fined $250 under the same rule at the Wyndham meeting on the 8th April 2008.

Mr Allison stated that a suspension would be likely if another breach under this rule occurred in the near future, suggesting a monetary fine could be imposed on this occasion.

Mr Shirley was fined the sum of $350 and reminded of his professional obligations.
