In these circumstances Rule 870 (5) requires me to relegate Pyramid Magic to behind Overcast.

Facts:
At the conclusion of race 6 A. W. Kyle Builders Handicap trot an information A 7646 was lodged by Stipendiary Steward Mr. Tidmarsh under Rule 870 (5) alleging that the second placed horse by the Judge Pyramid Magic galloped across the finishing line and was subsequently lapped on by Overcast who finished third.
Mr. Williamson who drove Pyramid Magic and who represented the owners viewed the video clip and did not wish to contest the protest or be present at the hearing.

Rule 870(5) states:
Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject Rule 869(8)) such relegation of the horse shall be at the discretion of the Judicial Committee.

Mr. Ydgren demonstrated that Pyramid Magic when finishing quickly went into a gallop just short of the finishing line, in second place. Pyramid Magic was lapped on by Overcast who finished third.
Reasons for Decision:
I was satisfied that Pyramid Magic galloped just prior to the winning post and was not in its correct gait when it crossed the finishing line.
It was clear that Pyramid Magic had not suffered interference from any other runner and was lapped on by Overcast.
