Decision: An information was lodged by Stipendiary Steward Mr C J Allison under Rule 869 (3) (b) alleging that Mr K F Franks, driving MARCHING HOME, shifted ground inwards when insufficiently clear of SAIL FOR HOME,
An information was lodged by Stipendiary Steward Mr C J Allison under Rule 869 (3) (b) alleging that Mr K F Franks, driving MARCHING HOME, shifted ground inwards when insufficiently clear of SAIL FOR HOME, driven by B D McLellan, causing that horse to break.
--Mr Franks admitted the breach.
--Stipendiary Steward Mr P Knowles used several video clips to highlight the alleged incident. Mr Knowles stated that MARCHING HOME started at number three on the front line and CLEAR OF SAIL started at number two on the second line.
--Mr McLellan stated that after the mobile dispatch, he followed his line through, with MARCHING HOME racing three wide in front of him. Mr McLellan yelled out to Mr Franks to give him some room, however he moved down inwards, squeezing his horse, SAIL FOR HOME, for room, eventually breaking.
--Mr Franks thought he had enough room, but on viewing the video clips acknowledged that he had made an error of judgement.
--In fixing penalty, Mr Franks has had 140 lifetime drives, and currently has one horse in work. He had no previous charges under this rule in the past twelve months. Mr Franks was fined the sum of $200.00.
