Facts:
At the conclusion of Race 8 the AON Insurance Equine Stakes Mobile Pace, an Information A 4401 was lodged by Stipendiary Steward, Mr S Renault alleging that Miss J Young (Delightful Dash) drove carelessly passing the 400 metres when shifting outwards, checking B D Windermere (A Armour).
The Rule 869 (3) (B) reads “No horseman shall drive carelessly.”
Miss Young admitted the breach and confirmed she understood the rule.
After consulting with senior horseman Mr M Williamson, she did not require his assistance at the hearing.
Stipendiary Steward, Mr Renault demonstrated the incident by the use of the video films. Mr Renault stated that Miss Young has made a simple error of judgement, when moving out when not clear of B D Windermere (A Armour) who had moved into the gap when trailing Delightful Dash in the three wide racing line.
Miss Young when moving out has made contact with B D Windermere causing that horse to be checked and lose its chance.
Miss Young agreed with Mr Renault’s summary of the incident.

Mr Renault said that Miss Young’s movement out was not severe and that Miss Young has made a basic error of judgement. Mr Renault stated he believed the carelessness was at the lower end of the scale.
Miss Young had no previous breaches under this rule in the past twelve months and had 67 drives last season 2013/2014 and 27 drives from 1 August 2014 until today.
Miss Young had no submissions on penalty.

In arriving at an appropriate penalty I considered the penalty submissions as presented. The JCA Penalty Guide recommends a fine of $400 as a starting point.
The mitigating factors in this charge are Miss Young’s good driving record and her early admittance of the breach for which she has received some reduction in penalty.
The aggravating factor is that B D Windermere was checked and lost its chance.
I considered this breach to be at the lower end of the scale of carelessness.
