At the conclusion of Race 1 (Joy White Appreciation Mobile Trot) a protest was lodged by Stipendiary Steward Mr C J Allison under Rule 870 (3) & (4) alleging that the fifth placed horse (SOLAR SPARK) driven by Mr R May, broke in excess of 50m inside the final 200m and was in breach of the Breaking Horse Regulations and Rule 870 (3).

At the conclusion of Race 1 (Joy White Appreciation Mobile Trot) a protest was lodged by Stipendiary Steward Mr C J Allison under Rule 870 (3) & (4) alleging that the fifth placed horse (SOLAR SPARK) driven by Mr R May, broke in excess of 50m inside the final 200m and was in breach of the Breaking Horse Regulations and Rule 870 (3).

The Rule reads :

--

(3) Any horse which breaks from its gait shall promptly regain its proper gait.
(4) Any horse which breaks from its gait in any race and : - (a) which fails to promptly regain its proper gait

Mr Allison used video film to highlight the alleged incident stating that with approximately 100 m to race, horse No 1 SOLAR SPARK (R May) broke and failed to regain its gait and finished in 5th place.  Mr Allison used the markers to point out that SOLAR SPARK did in fact gallop for some 100m.

Mr Jenkins, who represented Mr K Townley, Trainer of SOLAR SPARK, did not dispute the evidence.
 
DECISION & REASON

--

The Committee upheld the protest and disqualified SOLAR SPARK (R May) from 5th placing, and promoted STRATH ILA VILLAGE (No 9) to 6th.  As a result, No. 4 EMILY JACCKA was promoted from sixth placing to fifth.

--

The amended placings now read :
1st  8,   2nd 16,   3rd 15,   4th  17,   5th  4,  6th 9.
