At the conclusion of Race 1, the Joy White Appreciation Mobile Trot, an information #66880 was laid by Stipendiary Steward Mr C J  Allison, under Rule 869 (3) (b) alleging that with approximately 450 metres to run FEATHERS FIRST (A Milne) shifted ground inwards when insufficiently clear of RHYTHMIC SUN (A L Clark) causing RHYTHMIC SUN to break from its gait.

At the conclusion of Race 1, the Joy White Appreciation Mobile Trot, an information #66880 was laid by Stipendiary Steward Mr C J  Allison, under Rule 869 (3) (b) alleging that with approximately 450 metres to run FEATHERS FIRST (A Milne) shifted ground inwards when insufficiently clear of RHYTHMIC SUN (A L Clark) causing RHYTHMIC SUN to break from its gait.

The Rule reads that No Horseman shall drive carelessly.

--

Mr Milne did not admit the breach.

--

Stipendiary Steward Mr Allison showed the Committee several video clips of the alleged incident highlighting, in his opinion, the inward movement of FEATHERS FIRST onto RHYTHMIC SUN.  Mr Allison also highlighted the racing positions of JACCKA HELLO (J W Cox) who was travelling four wide outside FEATHERS FIRST and RHYTHMIC SUN (A Clark) who was racing two wide.  Mr Allison also stated that there was “clear space for all horses at point”.
When questioned, Mr  Cox stated that he was improving on the outside of FEATHERS FIRST, he made no contact and did not contribute to the incident.

Mr Clark said that there was pressure from the outside, and he was squeezed down and had nowhere to go.  Mr Clark said he did not contribute to the incident.

Mr Milne said he was improving around RHYTHMIC SUN, who he thought was battling and that he made every effort not to make contact and that his horse’s head was pointing outwards and travelling much quicker than RHYTHMIC SUN.  Mr Milne also stated that he thought EMILY JACCKA (A R Beck) may have shifted outwards when racing on the inside of RHYTHMIC SUN, contributing to the incident.
 
DECISION & REASON

--

The Committee was satisfied that interference did take place  -  Mr Milne shifting inwards when not sufficiently clear, causing RHYTHMIC SUN to break.

--

Mr Allison was required to give submissions on penalty, stating that he believed the interference was, in his opinion, at the lower end of the scale.  Mr Allison also stated Mr Milne had an exemplary record as a Senior Horseman, over a long period of time.

--

Mr Milne believed the Committee should have given him the benefit of the doubt on this occasion.

--

In fixing penalty, the Committee took into consideration Mr Allison’s relevant comments and fined Mr Milne the sum of $200.00.
