An information instigating a Protest was filed by Stipendiary Steward Mr C J Allison under Rule 869(8)(b) against REGINALDO (No.3) driven by R Swain alleging just after the start REGINALDO shifted ground inwards onto FRANCO RENEGADE driven by A Beck.

An information instigating a Protest was filed by Stipendiary Steward Mr C J Allison under Rule 869(8)(b) against REGINALDO (No.3) driven by R Swain alleging just after the start REGINALDO shifted ground inwards onto FRANCO RENEGADE driven by A Beck.

Mr Allison began proceedings by highlighting the alleged incident on video, pointing out where REGINALDO (No.3) ran out greenly (about 1 cart width) then moved back into it's correct space contacting Mr Beck's horse (No.10) FRANCO RENEGADE, causing it to break and lose some two lengths, and its position.

Mr Beck used the same film and confirmed previous facts presented by Mr Allison and Mr Swain. He added that his horse was 'pulling', was on the bit, and when offered the space ahead, made an attempt to move into it. Meanwhile, Mr Swain had taken hold of his horse and attempted to return to his correct position - No.2 behind the mobile arm. Under questioning, Mr Beck confirmed that his horse had, in fact, contributed to the problem by 'pulling' and by attempting to fill the partly vacated position ahead of it

Both parties agreed that both young horses were racing 'greenly' and that both had contributed to the incident. Mr Swain's horse (No.3) REGINALDO actually clipped Mr Beck's horse's front feet, causing it to break.

DECISION:

The Committee decided to dismiss the protest.

REASONS:

--

Video film clearly showed that whilst REGINALDO did move outwards from its correct position behind the gate, Mr Beck's horse FRANCO RENEGADE was 'on the bit' and pulling, attempted to fill the partly vacated spot. Mr Swain's horse then moved back into its correct position, 'flicking' FRANCO RENEGADE's front foot.

In the opinion of the committee, both parties contributed in part to the incident.
