Following the running of Race # 10 the “John Deere XUV Terrain Gators Mobile Pace” an information was lodged by Stipendiary Steward S Renault alleging a breach of rule 869 (3) (b) in that JW Cox “drove carelessly with 400m to run by allowing “Homeforabubbly” to shift outwards and contact “Julia Jones” causing “Julia Jones” to break and lose its chances in the event.”
Rule 8969 (3) (b) reads:
No horseman in any race shall drive:
(b) carelessly.
Mr Cox admitted the breach.
Submissions for Decision:
Mr Renault stated that Mr Cox shifted outwards when not sufficiently clear of "Julia Jones" causing that runner to break. He acknowledged that Mr Cox may have been having difficulty with his vision due to the slushy track, but it was Mr Cox’s obligation to make sure there was room for him to shift into.
Mr Cox stated it was an error of judgment on his part. He agreed that visibility was an issue but admitted he should have taken more care.
Submissions for Penalty:
Mr Renault said Mr Cox was a very busy horseman and had driven approx. 346 times this season to date. He said he had driven approx. 401 times in the previous season. Mr Cox had a clear record with no breaches of a similar rule in the past 12 months. However, he said the owners had lost stake money and another runner had lost its chances. Under the penalty guide a fine of $500 or a 10 drive suspension was a starting point. However, due to Mr Cox’s good record he sought a fine of $300.
Mr Cox accepted the submissions made by the Stipendiary Steward. He had admitted the charge at the first opportunity, his record was good and he was in a position to pay a fine.
Reasons for Penalty:
The committee took into account Mr Cox’s excellent driving record, his early admission of the breach of the Rule, and also the poor driving conditions on the day (weather and slushy track). Mr Cox was given credit for those mitigating factors and the committee believed a fine was appropriate.
