The committee upheld the protest and "Homeforabubbly" is relegated from 5th placing to 10th placing.

The official placings are: In The Kitty (9) 1st; The Wrath Of Robyn (11) 2nd; Last Issue (6) 3rd; Deano Robyn (5) 4th and John Paul Jones (7) 5th.

Facts:

Following the running of Race # 10 the “John Deere XUV Terrain Gators Mobile Pace” a Protest information was lodged by Stipendiary Steward S Renault alleging a breach of rule 869 (8) in that “Homeforabubbly interfered with the chances of Julia Jones when shifted outwards about the 400m mark.”

The Protest was not contested and the connections of" Homeforabubbly" were represented by Mr Cox.

Rule 869 (8) reads:

The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:

(a) May have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or

(b) May have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses:-

immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.

Submissions for Decision:

Mr Wallis, with the aid of the video replays, pointed out the relevant positions of "Homeforabubbly" and "Julia Jones" in the lead up to the incident.

Mr Renault stated that "Homeforabubbly" was trailing the leader. Approaching the 500m mark the leader began to tire and drift backwards onto "Homeforabubbly". Mr Cox was unable at that point to improve outwards due to the packed nature of the field. Approaching the 400m mark "Homeforabubbly" was observed to shift outwards resulting in the outside wheel coming into contact with the front leg of "Julia Jones", causing "Julia Jones" to break and lose any chance. Also at this point Mr Cox was observed taking his driving glasses off. "Homeforabubbly" finished in fifth placing and "Julia Jones" in 10th placing.

Mr Cox stated that approaching the 400m mark he was forced to take his driving goggles off to get a better view. He stated visibility at that point was not the best (due to the slushy track). When he shifted outwards he made a quick glance to see if there were any runners on his outer but did not see "Julia Jones" improving.

Reasons for Decision:

The committee considered the evidence of both parties and agreed that the chances of "Julia Jones" were seriously affected. Mr Cox had shifted outwards when not sufficiently clear of "Julia Jones" resulting in the sulky coming into contact with that runner causing it to break.
