Facts:

Following the running of Race 1, the JOHN DEERE 6000R SERIES TROT, an Information instigating a protest was filed by Stipendiary Steward Mr C Allison, alleging that near the 1400 metres mark Father Christmas broke in excess of 150m.

The Judge's placings in this race were as follows:

4th Father Christmas

5th Golden Gate

Rule 870 (4) (a) provides as follows:

(4) Any horse which breaks from its gait in any race and:-

(a) which fails to regain its proper gait.

Rule 869(8) provides as follows:

The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:

(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or

(b) may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, -

immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.

The Breaking Horses regulations provide as follows:

Where a protest has been duly lodged against the placing of an offending horse, the Judicial Committee shall either:-

(i) Relegate such horse under Rule 870 (4) to behind any other horse in respect of which and advantage may have been gained; or

(ii) Disqualify it from the race under Rule 1003 (2)

Submissions for Decision:

Mr Allison, with the assistance of the videos, stated Father Christmas had improved to the parked out position near the leader with a lap to run. Approaching the 1400m mark, Father Christmas appeared to knuckle over behind and subsequently broke from its gait. The break continued in excess of 150m before Father Christmas regained its proper gait. The horse then caught the tail of field and ran on strongly in the home straight finishing in fourth position.

Mr Brad Williamson confirmed that Father Christmas had knuckled over behind causing it to break. He reviewed footage of the videos and was of the view the horse had broken only 150m before retaining its proper gait.

Reasons for Decision:

Rule 870 (4) (a) is clear in that a horse not in its correct gait must regain its correct gait within the allowable distance under the regulations. The videos show that Father Christmas was in a break in excess of 150m. The committee is satisfied that Father Christmas was in breach of the Rule.
