Mr Walkinshaw indicated on the information that he admitted the breach and did not wish to appear before the Committee. I therefore find the charge proved.

Penalty:

Mr Walkinshaw is fined the sum of $225.

Facts:

Mr Allison alleged that in Race 7, the CENTRAL SOUTHLAND LODGE MOBILE PACE, Mr Walkinshaw used his whip excessively over the concluding stages when driving out NOTHINGFOR THE MEDIA.

Submissions for Penalty:

Mr Allison demonstrated on the videos that the respondent was 3 wide challenging for the lead as the field entered the home straight, and had hit the horse some 22 or 23 times as the horse, which finished third, 4.3 lengths from the winner, progressed down the straight. He acknowledged there were some pauses and that on occasion the horse had gone “rough” for stride or two. He said it was not the worst example of a breach of this rule and the strikes were not that forceful. He produced Mr Walkinshaw’s record, which showed a previous breach on 8 November last when the penalty was a fine of $200. Mr Allison submitted a fine of $250 was appropriate on this occasion.

Reasons for Penalty:

I agree with Mr Allison that the breach is low end. There are 22 to 23 strikes with the whip and there are some pauses including Mr Walkinshaw running the whip through the tail of the horse. Mr Walkinshaw has had 174 drives this season and had 281 drives the previous one. He is a busy driver and thus his record under this rule can be said to be good. He has also admitted the breach and co-operated with the stipendiary stewards.
