Facts:
Following the running of race 10 the Speeding Spur at Woodlands Mobile Trot, a protest was lodged by Stipendiary Steward, Mr V Munro alleging that RYDGEMONT SON gained an advantage by racing inside the pylons for over 70 metres in the home straight.
The Judge’s placings were: -
1st - 7 Humble Ladd (B Williamson)
2nd - 9 Rydgemont Milly (J Morrison)
3rd - 4 Tweedledee (N Williamson)
4th - 6 Rydgemont Son (M Williamson)
5th - 1 King Cassidy (S Tomlinson)
Rule 869 (A) Provides
(1) For the purpose of this rule:
(a) ”placed horse” means a horse placed by the judge 1st, 2nd, 3rd, 4th or 5th.

At the commencement of the hearing Mr M Williamson was asked if he understood the Rule, which he confirmed. Mr Williamson also confirmed he was representing the Owners of the horse, as well as being the Trainer and Driver.
Submissions for Decision:
Mr Munro showed the race video replays, from the horses entering the home straight for the final time until passing the winning post. Mr Munro highlighted the two horses CHLOE ROSE (B Orange) and ZONED SCARLETT (B Barclay) who were racing in tight quarters.
The video also highlighted ZONES SCARLETT and CHLOE ROSE, locking Sulky Stays with ZONED SCARLETT moving inwards slightly.
Mr Munro further highlighted RYDGEMONT SON moving through on the inside of these horses and in doing so going inside the pylons for about 70 metres before returning onto the racetrack and finishing resolutely for fourth placing.
Mr Williamson stated that the track was very slushy, and that he had attempted to move inside ZONED SCARLETT noting that CHLOE ROSE and ZONED SCARLETT had locked Sulky Stays. Mr Williamson said there was some inward movement from the outside horses, and as a result he took some minor action and went inside the pylons.
Mr Williamson said that his horse effectively lost ground in doing so, and the incident almost certainly denied his horse third placing.
Reasons for Decision:
After carefully considering all of the evidence, and viewing the films, in particular the head on film it was clear that RYDGEMONT SON did not gain an advantage by racing inside the pylons. The nature of the slushy track and the very tight tracing quarters of CHLOE ROSE and ZONED SCARLETT have made it difficult for RYDGEMONT SON to progress in a straight line to the winning post, possibly preventing the horse finishing in third placing.
