Stipendiary Steward Mr P Knowles alleged that with approximately 350m to run HIGHBALL (AM Armour) shifted outwards onto SEAFARER (BR Shirley) when insufficiently clear of that runner. Mr Knowles stated he was seeking relegation of HIGHBALL behind SEAFARER which finished 10th.

--Video evidence showed Mr Armour in the trail moving out and causing SEAFARER to scramble and go into a break losing ground and coming back onto OUT OF THE MIST, taking it back with it. SEAFARER had been in the one-one position and could not manoeuvre as Mr Beck and TARTAN ROVER had him boxed in. The video evidence from the view from the inside clearly showed SEAFARER's head go into the air and lose his excellent position and take OUT OF THE MIST with him. OUT OF THE MIST finished second, only a length from the winner HIGHBALL.
--In evidence, Mr Shirley said he was in the one-one. His horse kept whacking away and the lead horse was stopping causing Mr Armour to take the action he did. Mr Beck was outside him, so he went back in a scramble and took the horse behind him with him (OUT OF THE MIST, which finished second). Based on his toughness he said he was sure he would have run a place.
--Mr Beck said Mr Shirley was yelling to Mr Armour and had nowhere to go.
--Mr Barclay said he had to come out from his three wide position, as Mr Shirley had nowhere to go and he would have hit the deck if he hadn?t.
--Mr Armour said to note how he gradually eased out. He said "things got tight, however there was enough of a gap to warrant going there, it was a very gradual movement". He said he felt Mr Shirley's horse was flat even though he had said it would stick on.
--Mr Murdoch asked if there was any contact. Mr Armour said, No. Mr Shirley said, Yes. Mr Shirley said it didn?t matter anyway as his horse had the right to be there and continue to stand up. Mr Barclay concurred. Mr Murdoch said to Mr Shirley. "Was your horse still travelling?" Mr Shirley replied, "Yes".
--In summary, Mr Knowles said Mr Armour had moved out when insufficient room was available. He did this when at a disadvantage and caused interference. He was not entitled to come out. At the Chairman's request, Mr Knowles re-read the rule.
--Decision:
--The Chairman agreed with Mr Shirley, Mr Barclay, Mr Beck and Mr Knowles. Mr Shirley has the right to be there and Mr Armour moved out because the leader was stopping and he had no right to do this. This caused Mr Shirley to lose a potentially stake bearing place. Mr Barclay did not feel he would have won but stated Mr Shirley had the right to be where he was and a chance to pay a dividend.
--HIGHBALL, No.3, was relegated to behind SEAFARER which finished 10th. The other place-getters were promoted.
