DECISION & REASON:

--

It was agreed by all parties that all evidence pertaining to the alleged incident of the protest hearing (Information 13308) be accepted.

--

Stipendiary Steward Mr Allison showed the committee several video clips of the alleged incident (Front ? Side and Back).

--

The Committee also heard from Mr Armour who clearly admitted he had made an error of judgement, but stated that he believed that his outward movement (HIGHBALL) was gradual, not sharp.

--

Mr Knowles produced Mr Armour's recent driving record, which showed Mr Armour had been recently fined under the same rule.

--

Mr Knowles also stated that in his opinion the incident was at the higher end of carelessness.

--

Mr Armour was suspended up to and to the conclusion of racing on 11 May 2006 and he was also fined the sum of $150.

--

In fixing penalty the Committee considered the following points ?

  • Mr Armour's early guilty plea

  • Mr Armour's recent driving record
  • --
  • The loss of any stake-money to the owners of HIGHBALL
  • --
  • The chances of the affected horses running into a higher stake/dividend bearing place

The split penalty was a result of the upcoming dual code meeting at Gore on Sunday 7 May 2006, where raceday opportunities were still to be determined at the time of fixing penalty.
