Following the running of Race 8, The AB Lime Mobile Pace, a protest was instigated by Stipendiary Steward Mr P T Knowles against second placing being awarded to horse 7 Lady Marmaduke (S P Renaault) on the grounds that in the score up, Lady Marmaduke broke, checking Regent Sands (A M Armour) and disorganising the second line of runners.

Rule 869(8)(b) reads:  The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:

--

 

--

(b) may have interfered with, or whose horsemen may have interfered with, the progress or chance of any other horse or horses,-

--

 

--

immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.

--

Present at the hearing were trainer of Lord Marmaduke, Mr G Manson, driver, Mr S Renault who was assisted by senior horseman, Mr M Jones.  The connections of Regent Sands were represented by driver, Mr A Armour and trainer,  Mr T Kilkelly who arrived during the hearing.  Starter, Mr B Ward was also present.

Video of the run up to the start was shown by Stipendiary Steward Mr C Alison.  This shows Lord Marmaduke giving Mr Renault a difficult drive in trying to get his horse straightened up and to take up its correct position at six on the front line.

Also shown is Regent Sands, which had drawn three on the front line in a gallop for a short period in the run up when in close proximity to Lord Marmaduke.

Mr Armour stated that he had been inconvenienced by the manners of Lord Marmaduke and that it was not in fact a legitimate start.  It was not only his horse, but a number of other runners as well, which did not get a fair go.

Mr Jones states that he was in a good position from his draw at three on the second line to observe what took place.  In his view the second line runners had attempted to take an extra round after being called up by the starter.  He could see that Mr Renault was not having an easy drive, but also that he did not interfere with anyone.

Starter, Mr B Ward stated that the horses were way back from the dispatch point, some 150 metres, when the disorganisation involving Lord Marmaduke and Regent Sands occurred and that they had both ample time as well as room to take up their rightful positions, but they could not get up to the gate.

Mr Renault and Mr Kilkelly both stated that they were happy with the manner in which events had been described, Mr Kilkelly adding that it was no like his horse to  gallop.

--

Assessing all evidence presented, the Committee was satisfied that the start, although appearing disorganised, was legitimate.  Contributing to this was the fact that the second line horses had mostly failed to respond to the starters call up instruction. Any alleged interference to Regent Sands by Lord Marmaduke is not substantiated and the protest is  therefore dismissed.
