Decision:

At the conclusion of Race 3, the McDonald Excavating / Top End Takeaways Mobile Pace an information (66877) was lodged by Stipendiary Steward Mr C J Allison under Rule 857 (7) (D) that Junior Horseman Mr C M Hanna, the driver of GEORGI BOY, failed to come up to the mobile barrier and was out of position at the start.  The Rule states that No horseman shall come to the starting gate out of position.



At the conclusion of Race 3, the McDonald Excavating / Top End Takeaways Mobile Pace an information (66877) was lodged by Stipendiary Steward Mr C J Allison under Rule 857 (7) (D) that Junior Horseman Mr C M Hanna, the driver of GEORGI BOY, failed to come up to the mobile barrier and was out of position at the start.  The Rule states that No horseman shall come to the starting gate out of position.

Mr Hanna admitted a breach of the Rule and was supported in the hearing by Senior Horseman Mr C J Barron.  Mr A Paisley, the trainer of GEORGI BOY, was also present.

Stipendiary Steward Mr Allison stated that GEORGI BOY’s starting position was officially number one on the unruly position.  Mr Allison used several video clips of the alleged incident to highlight GEORGI BOY’s starting position, which he estimated as being about 40 metres away from the official point of the mobile dispatch.  Mr Allison also stated that GEORGI BOY finished the race off strongly into second place, only one length from the winner.

Mr Hanna stated that he was unaware that he was that far back, and that the horse had raced fiercely at the Wyndham Trials recently, and for that reason the trainer, Mr Paisley, had requested to the Stipendiary Stewards the horse be placed on the unruly list.

Stipendiary Steward Mr Knowles and Mr Paisley confirmed Mr Hanna’s statement.
Senior Horseman Mr Barron stated that Mr Hanna had simply made an error of judgement.

DECISION

--

The Committee found that a breach of the Rule had occurred, therefore the charge was proven.  The Committee requested submissions on penalty.

--

Mr Allison stated that the breach of the Rule was at the higher end of the scale.  He also said Mr Hanna had an outstanding driving record, with no blemishes under any rule on his record.  Mr Hanna stated that he was having five to six day race drives currently and wished the Committee to consider his driving record when fixing penalty.

In fixing penalty the Committee took into account Mr Hanna’s admittance of the breach and his exemplary driving record.  Consideration was also given to the fact that the horse GEORGI BOY started from the unruly position and that it was his first race day start.

The Committee believes the breach was at the high end of the scale and that it is important for public perception that an appropriate penalty be imposed.

--

Mr Hanna was fined the sum of $250.00 and reminded of his professional obligations surrounding the start of any race.
