Decision: An information was filed by Stipendiary Steward Mr PT Knowles, under Rule 869(3)(b)  - Careless Driving – alleging that Mr AL Stratford (SAKWI) allowed his horse to shift inwards when insufficiently clear of TRENDY’S ROCKET

DECISION AND REASON:

--

An information was filed by Stipendiary Steward Mr PT Knowles, under Rule 869(3)(b)  - Careless Driving – alleging that Mr AL Stratford (SAKWI) allowed his horse to shift inwards when insufficiently clear of TRENDY’S ROCKET (BD McLellan) striking it’s front legs thereby causing interference .

At the commencement of the hearing Mr Knowles and Mr Stratford agreed to accept all of the previous evidence from the protest hearing, Information No.13345.

Mr Knowles revisited the video clips to highlight the previous points made.  Mr Knowles stated that Mr Stratford was “too late” in reacting to his horse moving in, resulting in the interference occurring.

Mr Stratford stated that his horse threw its head outwards prior to moving in, and as a result he had difficulty in controlling the horse.

Decision:

--

After reviewing the evidence from the protest hearing (13345) and the additional summation from Mr Knowles and Mr Stratford, the charge of careless driving was upheld.

--

Clearly the verbal evidence of Mr McLellan, and the video clips support the fact that SAKWI has moved inwards.

--

Mr Stratford has, in my opinion, allowed his horse to move from the four wide line into at least the three wide line.  He has failed to react, or take any evasive action, and has only reacted after the interference took place.

--

I do not accept the horse’s heads outward movement happened prior to the horse SAKWI moving inwards.

--

In fixing penalty, Mr Knowles stated that Mr Stratford had an excellent driving record over the previous twelve months and that the breach was at the lower end of the penalty scale.

--

Mr Stratford stated that he had twelve horses in work, and was driving four to five horses on most harness racedays.

--

Mr Stratford was fined the sum of $300.

--

Consideration was given to Mr Stratford’s driving record, and also to the fact that his horse had been relegated from first place to third place, and had affected the horse’s owners, and the betting public financially.
