Under Rule 869 (3) (f) Stipendiary Steward Mr C J Allison alleged that "with approximately 400m to run Mr G J Thomas, driving MY MJ, dropped his leg from the sulky and used it as a bar".
--Mr Thomas freely admitted the charge.
--Video evidence was shown and confirmed the incident. Under Rule 1111 (1) (d) I find the charge proven.
--Submissions as to penalty were taken and Mr Allison said Mr Thomas had been forthright in admitting the breach before he was charged. He also said that Mr Thomas had not even been spoken to, let alone charged, in the past 12 months. He requested a fine of $200 - $250.
--Mr Thomas had no submission to make.
--I take Mr Thomas' forthright admission and clean record for the past 12 months into account and fine him $200.00.
