As Ms Vance admitted the breach the Committee found the charge proved.

Penalty:

Accordingly, Ms Vance had her license to ride in races suspended for a period to commence after racing on 6 January and conclude after racing on 13 January 2018.

Race meetings on 7 January were not included in Ms Vance’s suspension because the declaration of riders had closed.

Facts:

Following the running of race 8, Trigg Construction, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Williamson, alleged that Ms Vance allowed her mount WINKLE DANCER to shift in when not sufficiently clear of MAZIKEEN which was dictated into the line of VIVA LA BURGUNDY which was checked.

Ms Vance acknowledged that she understood the Rule and confirmed her admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Coles demonstrated on the video films that Ms Vance allowed her mount to shift into the line of MALIKEEN near the 1100 metres when not sufficiently clear. He said this resulted in that runner being dictated into the rightful line of VIVA LA BURGUNDY which was checked.

Ms Vance said that she did not leave enough room for MALIKEEN when shifting in. She pointed out that VIVA LA BURGUDY was over racing and this contributed to the check.

Submissions for Penalty:

Mr Williamson produced Ms Vance’s record which showed no previous breach under this Rule in the last 12 months. He said Ms Vance should be given credit for her admission of the breach and her clear record. He said the level of carelessness was low range but added that VIVA LA BURGUNDY did receive a decent check which would put the overall incident in the low to mid-range.

Ms Vance advised that she had no engagements in the next 7 days and any proposed suspension could start immediately. She described the carelessness as low end.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented.

Our interpretation of the incident was that Ms Vance allowed her mount to shift in 1 horse width when not the required distance clear of MALIKEEN near the 1100 meters. This resulted in that runner being dictated into the running line of VIVA LA BURGUNDY. We observed that VIVA LA BURBUNDY was over racing at the time of the incident which accentuated the check. The Committee deemed the carelessness to be low range.

The Penalty Guide for Judicial Committees recommends that the starting point for low range carelessness is 6 National riding days.

There were no aggravating factors.

The mitigating factors were Ms Vance’s admission of the breach and her excellent record. For these collective factors we afforded her a 2 day reduction.
