As Mr Cole admitted the breach the Committee found the charge proved.

Penalty:

Mr Cole was fined $200.

Facts:

Following the running of race 1, Fell Engineering, an Information was filed pursuant to Rule 614(2). The Informant, Mr Williamson, alleged that Mr Cole saddled BEYOND DISPUTE with the wrong saddle.

Mr Cole acknowledged that he understood the Rule and confirmed his admission of the breach.

Rule 614(2) provides: A person must not be neglectful or careless in saddling a horse.

Mr Williamson advised the Committee that Mr Innes (the rider of BEYOND DISPUTE) had alerted the Stewards approximately 13 minutes prior to race 1 that his saddle had not been collected. During the Stewards investigation it was found that Mr Cole had already saddled BEYOND DISPUTE and he had mistakenly picked up the wrong saddle.

In response to a question from the Committee, Mr Williamson said that BEYOND DISPUTE had not been presented to race with the incorrect saddle.

Mr Cole admitted that he collected the wrong saddle and when an error had been identified BEYOND DISPUTE was re saddled.

Submissions for Penalty:

Mr Williamson said that Mr Cole was forthcoming with the Stewards and a bad mix up had occurred. He said there were no real consequences apart from the horse had to be re saddled. He submitted a $200 fine would be appropriate.

Mr Cole made no submissions on penalty.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented.

The JCA Penalty Guide has a starting point for neglect in saddling but does not cover a Trainer saddling a horse with the wrong saddle.

We referred to the JCA Listing of penalties when deliberating but there was no guidance as this breach was unprecedented.

The Committee considered that a $200 fine would be appropriate.
