Following Race 9 an Information was filed pursuant to Rule 638 (1) (d).  The informant Mr Williamson alleged that Miss A Collett permitted her mount to shift inwards near the 1700 metres when not sufficiently clear causing DANCING CHIEF (P Taylor), SKANDEL (A Ng) and ACE HIGH (T Thornton) to be checked.

FACTS:

Mr Oatham demonstrated the video films which showed TRACK BRATT (A Collett)

--

racing in a 4 wide position nearing the 1700 metre mark.  Shortly after passing this point when approaching the turn out of the straight Miss Collett angled her mount in towards the rail endeavouring to take the lead.  It was clear on the film that she was only a bare length clear of DANCING CHIEF on her inside.  This caused Mr Taylor to check his mount which resulted in crowding to SKANDEL and ACE HIGH on his inside.

Miss Collett told the Committee she felt the horses on her inside may have overreacted to her inward movement.

Mr R Collett said he believed that ACE HIGH and DANCING CHIEF were both racing unkindly just prior to Miss Collett moving inwards.

SUBMISSION(s) ON PENALTY:

Mr Williamson told the Committee that Miss Collett was still very inexperienced and this was her first charge.  He submitted this offence was at the low end of carelessness.

Miss Collett said her only committments were at the Counties meeting tomorrow (7/8/10).

REASON(s):

--

The Committee considered all evidence and submissions before imposing an appropriate penalty.  In Miss Collett’s favour are her inexperience, this was her first charge and the incident occurred on the point of the turn which always makes margins harder to judge.  However she was not the required distance clear with three horses being affected.  Taking these factors into account the Committee has found Miss Collett’s carelessness is at the low end.

PENALTY:

Accordingly we impose a suspension on Miss A Collett from riding in races which is to start after racing on 7 August and conclude after racing on 14 August 2010 (4 days).
