RACEDAY JUDICIAL COMMITTEE DECISION

--

Informant:  Mr M Williamson

--

Defendant:  Mr M Cameron

--

Information No: 423

--

Meeting:  Whangarei Racing Club

--

Date:  6 August 2010

--

Venue:  Ruakaka

--

Race:  1

--

Rule No:  330 (3) (c)

--

Judicial Committee:  R Seabrook, Chairman – A Godsalve, Committee Member

--

Plea:  Admitted

--

--

CHARGES:

--

Prior to Race 1 an Information was filed pursuant to rule 330 (3) (c).  The informant Mr Williamson alleged that Mr Cameron failed to make the weight for LEICA HONEY.

--

--

FACTS:

--

Mr Williamson explained to the Committee that Mr Cameron had taken the ride on LEICA HONEY in race 1 at a carded weight of 54 kgs.  On weighing out it was found that Mr Cameron could only make 55 kgs therefore being 1 kg overweight.

--

--

SUBMISSION(s):

--

Mr Cameron said he had been on holiday but was confident when taking this ride he could make the 54 kgs.  However he admitted it was a miscalculation on his part and he had no further explanation.

--

--

SUBMISSION(s) ON PENALTY:

--

Mr Williamson said Mr Cameron had not incurred a charge under this rule in the last eleven months.  He said this was a huge improvement on Mr Cameron’s behalf as Mr Cameron had a lot of problems with his weight in the past.  Mr Williamson submitted a fine of $100 - $200 would be appropriate.

--

--

Mr Cameron had nothing to add regarding penalty.

--

--

REASON(s):

--

The Committee considered all evidence and submissions before imposing an appropriate penalty.  To Mr Cameron’s credit he has really addressed his weight problems over the last year.  The Committee also notes Mr Cameron’s guilty plea and his full cooperation with the Stewards.  However resulting from this charge today, was the need for a replacement rider for Mr Cameron in Race 1.

--

--

PENALTY:

--

After taking all the above factors into account we impose a fine of $150.
