Facts:

Prior to commencement of racing Mr M Williamson presented an Information alleging a breach of Rule 534(2)(b) in that Ms Guy, the Trainer of EMPRESS QI, failed to scratch her horse from starting in Race 4 before the required scratching time of 7.30am today.

Ms Guy admitted breach. She stated that the horse was also entered to race in Race 3 and had declared a Rider for that race and intended the horse to be scratched from Race 4 but had simply overlooked doing so in time.

In fact, NZTR contacted Ms Guy at 7.31am to advise that she had not complied with the requirement and had itself declared the horse to be scratched.

Submissions for Penalty:

The Stipendiary Stewards advised that they would leave the appropriate penalty up to the Committee.

Reasons for Penalty:

Rule 534(2)(b) usually applies to a situation where a Trainer seeks an authorisation from the Committee to “late scratch”. But purposely applied, it may relate to the situation where a Trainer fails to scratch within the required time and therefore must from that moment need the authorisation required und the Rule – irrespective of what action NZTR takes.

The Committee accepts Ms Guy’s submission that this was innocent oversight on her part. But authorisation cannot be granted as some deterrent sanction is necessary.
