As Mr Innes admitted the breach it was found proved.

Penalty:

It takes as a starting point suspension for 9 National Riding Days for high end carelessness and by reason of the aggravating matters of his questionable record since October 2020, we impose a suspension of 13 National Riding Days to commence at the end of racing on 8 May 2021 and finish at the end of racing on 28 May 2021.

In addition Mr Innes is fined $300 given that his mount won the race and earned a share of the winner's stake.

Facts:

Following the running of Race 1, the Northland Business Systems Maiden, Mr Williamson, Senior Stipendiary Steward presented an Information alleging a breach of Rule 638(1)(d) by Mr Innes, in that he rode DOUBTFUL SOUND carelessly.

Mr Innes admitted the charge and said he understood the Rule.

Rule 638(1)(d) provides:  that a Rider shall not ride a horse in a manner that is careless.

Mr A Coles identified the incident from the race films which showed that:

- Mr Innes angled his mount DOUBTFUL SOUND in order to move in approaching the 1100 metres shortly after the start.  In doing so he dictated the line of, and crowded the horse BODYGUARD (ridden by Ms T Thornton) causing subsequent crowding to ROC DANCER (ridden by Ms S Collett) which resulted in severe checks to both horses which lost considerable ground.

- Ms Collett's mount came into contact with the running rail.

Submissions for Penalty:

Mr Williamson submitted that the actions of Mr Innes fell into the very "high end" of careless riding and a charge of reckless riding had been in contemplation. He referred to Mr Innes' record of 3 suspensions (with some added fines) for careless riding over the past 12 months, and sought penalties of a 15 days suspension together with a fine.

Mr Innes said that from the start he had endeavoured to follow another horse (BURGUNDY DANCER) and thought he was clear of BODYGUARD (T Thornton) but that the racing manners of it led to its "overreacting" and forced some inside tightening. He asked that any suspension not start until after racing on 8 May 2021, as he had committed engagements then.

Reasons for Penalty:

The Committee is satisfied that Mr Innes' actions:

- were designed to dictate to those on his inside

- were seriously high end carelessness or negligent, bordering on recklessness

- severely hampered 2 horses on his inside, extinguishing any realistic chance they had

- very seriously inconvenienced Ms Collett on ROC DANCER.

In fixing a proper sanction, the Committee takes into account Mr Innes' senior and experienced status - he knows better than to angle across in the first 100 metres as he did.
