The Informant alleged that the Defendant, when angling in for a position closer to the running rail in the initial stage of the race after the start, made contact with, and forced ?Insignificant?(M Wenn) on to ?Fuelled? (R Gartner), causing ?Fuelled? to take the line of ?Jervis Bay? ( T Thornton) ? Jervis Bay falling as a result. The rider of ?Fivenone?, (L Hofmann) was also dislodged as a consequence of the fall.

The Stipendiary Steward called evidence from jockeys Wenn, Gartner and Thornton, and Assistant Stipendiary Steward Robinson demonstrated his opinions as to the alleged interference caused by the Defendant with the use of a video recording of the race.

In final summary, the Stipendiary Steward refuted the Defendants claim that there was sufficient room on her inside for the inner horses to maintain their line when she crossed to the rail.

In presenting her defence, K Davidson maintained she crossed gradually from an outside draw, and that her mount had ducked in when near to M Wenn's horse. The Defendant said she immediately straightened her mount, and felt that the cause of the fall was contributed to by the inexperience of the jockey Gartner in not responding to calls from jockey Wenn. The Defendant stressed her opinion that there was sufficient room on her inner for the three horses there to maintain their line.

The Committee found that the case against the Defendant Davidson had been proven, and agreed with the Assistant Stipendiary Steward's demonstrated

The Committee determined that the Defendant had crossed from an outside draw too acutely, and had caused the tightening and subsequent fall. The Committee also found that the room between the Defendant's mount and the rail was not as she had claimed, and that she had misjudged that fact.

In his submissions, the Informant stated that he felt that although the interference
--was ?not great? the consequent fall was serious and that the Committee should ?look to a suspension at the top end of careless riding?.

The Defendant's good record, (her most recent offending, a charge of careless riding
--at Thames on the 3 January 2004, drawing a 3 day suspension) was confirmed by the Informant, and he advised that she was known to be a rider who ?does not go out to interfere? when riding.

The Committee, after taking into account the Defendant's good record, and the fact that she had tried to take corrective action after contact, assessed the appropriate
--penalty to be within the band of a 2-3 week suspension. Whilst it was accepted that she had not admitted the breach, the Committee felt that she was entitled to credit for her record and the degree of actual interference, and a suspension of two weeks was imposed.

The suspension to start at the conclusion of racing on Saturday 3 June 2006, and conclude at the end of racing on Saturday 17 June 2006. This penalty equated to 5
