Decision:

The Committee accepts that the barrier was slow to open due to circumstances outside the control of DANCE or its rider, Mr Jones. On that basis we find that its chances of finishing in better position were materially prejudiced due to the starting gates being slow to open. DANCE did not finish in the first 3 and therefore qualifies for consideration pursuant to Rule 632.

Rule 632 states “If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-runner.”

Facts:

Following the running of R 6, the Kerikeri Colour Centre 1200, Mr R Jones rider of DANCE requested a ruling as to whether or not his mount received a fair start pursuant to Rule 632.

Submissions for Decision:

Stipendiary Steward, Mr M Williamson advised the Committee that due to severe weather conditions, particularly a very strong head wind, the starting gate of horse number 7 DANCE was slow to open. This was confirmed by the starter Mr T Harrison and Jockey Mr Jones.

Mr Jones told the Committee that he had to force the gate open and as a result DANCE was the second to last horse to leave the barrier and settled at the rear of the field. He said that he intended to race much handier but due to the slow opening of the barrier this was not possible. Mr Jones submitted that as a consequence his chances were severely affected.

Mr Williamson used video footage to demonstrate the start of the race. This clearly showed that the barrier gate was slow to open. 

Reasons for Decision:

The Committee declares number 7 DANCE a non-runner due to being disadvantaged as a result of its starting gate being slow to open.
