As Mr Lammas admitted the breach the Committee found the charge proved.
Penalty:
The Committee grants a deferment to Mr Lammas’ suspension pursuant to Rule 1106(2).
Accordingly, Mr Lammas had his license to ride in races suspended for a period to commence after racing on 7 October and conclude after racing on 14 October 2018.
Facts:
Following the running of race 4, Lion Red 1200, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Mr Lammas permitted his mount MUNNS JEWEL to shift inwards when not sufficiently clear of THE REFLEX which was checked near the 50 metres.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Lammas said that he understood the Rule and confirmed that he admitted the breach.
Mr Oatham demonstrated the incident using the available video footage. He identified that Mr Lammas was riding MUNNS JEWEL forward inside the last 100 metres when his mount was shifting in. As a result Mr Waddell was forced to check THE REFLEX to avoid MUNNS JEWEL'S heels. He said a minor contribution was THE REFLEX’S racing manners.
Mr Lammas admitted that he allowed his mount to “roll in” when not the required distance clear of THE REFLEX.
Submissions for Penalty:
Mr Williamson produced Mr Lammas’ record which showed 2 previous breaches under this Rule in the last 12 months, the most recent being on 27 January. He said this was a very good record and described the level of carelessness as low range. He added that there were a lot of green horses on debut in the race.
Mr Lammas said that he had firm commitments up to and including 7 October and any proposed suspension could start after that date.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented.
It was clear of the video films that Mr Lammas permitted his mount to shift in when only ¾ of a length clear of THE REFLEX. As a consequence that runner was crowded for room and hampered passing the 50 metres. It was evident that THE REFLEX raced greenly in the final straight on several occasions. The Committee deemed the level of carelessness was low range.
The JCA Penalty Guide starting point for low range carelessness is 6 days which was adopted.
There were no aggravating factors.
The mitigating factors were Mr Lammas' admission of the breach and his good record. For these combined factors Mr Lammas was afforded a 1 day reduction in penalty.
After taking into account all the above factors the Committee considered that an appropriate suspension was 5 national riding days.
