Mr Muirhead demonstrated the incident by use of the video film and identified the horse Charmed who was racing 4 wide at the 400 metre point, shifted in and caused interference to Flash Amber ( P. Jeffries) resulting in that horse breaking.

Penalty
--Mr Muirhead recommended a 2 day suspension. Mr M. Nicholas was made aware of this by Mr Muirhead prior to leaving the racecourse.

--Having taken into account the admission of the breach of this rule by Mr M. Nicholas and also the submissions on penalty from Mr Muirhead this Judicial Committee imposed a 2 day suspension up to and including 8/1/08
