As Mr Cameron admitted the breach we find the charge proved.
Penalty:
We grant Mr Cameron's request to seek a deferment to his suspension as per Rule 1106(2).
Accordingly, we impose a suspension on Mr Cameron which will commence after racing on 6 July and conclude after racing on 12 July 2013 (4 days).
Charge:
Following race 3, 92.4 FM Live Sport Northland 1400, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Coles, alleged that near the 200 metres Mr Cameron allowed his mount ANOTHER INVADER to shift in, when not sufficiently clear of JUST GOT HOME which was severely crowded, losing ground.
Mr Cameron acknowledged that he understood the nature of the charge and the Rule.
Rule 638(1) (d) provides: A rider shall not ride a horse in a manner which the Judicial Committee considers to be careless".
Facts:
Mr Williamson demonstrated the incident by using all the available films. He identified ANOTHER INVADER racing 1 off the rail approaching the 200 metre mark with JUST GOT HOME racing to her inside on the rail. He said that Mr Cameron allowed his mount to then shift inwards when only 1 length clear of JUST GOT HOME. This resulted in JUST GOT HOME rider having to take a hold of her mount. Mr Williamson further advised that ASGOODASITGETS contributed to the incident by moving in slightly on ANOTHER INVADER.
Mr Cameron informed the Committee that he agreed with Mr Williamson’s summary of the incident. He said he thought his horse was going better than JUST GOT HOME when he shifted inwards but acknowledged he was only 1 length clear. He also said at the time his mount was crowded by the inward movement of ASGOODASITGETS.
Submissions for Penalty:
Mr Coles produced Mr Cameron's record which showed 4 previous breaches under this rule in the last 12 months. He said Mr Cameron was a busy rider who travels extensively and described his record as good. He assessed the breach as being at the low end and submitted that Mr Cameron be given credit for his admission of the breach.
Mr Cameron submitted that he travels all over the country and is a busy rider. He asked the Committee to take into account his admission of the breach and the fact the breach was at the low end of the scale.
Mr Cameron requested a 7 day deferment to his proposed suspension due to his riding commitments over the next week.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension for this careless riding charge. The mitigating factors are Mr Cameron's admission of the breach, his good record particularly given that he is one New Zealand's busiest riders and we assess the level of carelessness as being at the low end of the scale. A further mitigating factor is that the Committee noted that prior to this incident Mr Cameron did look inwards to check whether there was sufficient room to shift in but he misjudged the distance between his mount and JUST GOT HOME. We have assessed the check received by JUST GOT HOME as being an aggravating factor and note that when balanced up JUST GOT HOME finished the race off strongly.
The Committee accepts that Mr Cameron has a history of riding all over the country and this is reflected in his penalty.
After taking into account all the above factors we assess an appropriate penalty is a 4 day suspension.
