As Mr Lammas has admitted the breach the Committee finds the charge proved.
Penalty:
Accordingly we suspend Mr Lammas' license to ride in races for a period of 4 days, commencing after racing on 5 September and concluding after racing on 13 September 2015.

Facts:
Following the running of Race 4, the HARCOURTS BLUE ANGELS 1200, an Information was lodged by Stipendiary Steward Mr A Coles alleging that Jockey Mr C Lammas, riding AMPERAGE, allowed his mount to shift in at the 1100 metres crowding and checking ZVEZDA MOYA ridden by Apprentice Rider Ms A Scwerin.
Mr Lammas was present at the hearing and indicated that he understood the Rule and that he admitted this Breach.
Rule 638(1)(d) provides that ' A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless'.
Using the available films Stipendiary Steward Mr M Davidson demonstrated the incident. He identified the horses AMPERAGE which started from barrier 5 and ZVEZDA MOYA which started from barrier 4 in this race over 1200 metres.
After the horses had travelled about 100 metres it was pointed out that Mr Lammas allowed his mount to shift inwards towards ZVEZDA MOYA. Ms Schwerin was forced to take a strong hold of her mount, as it was clear from the films that AMPERAGE had not been the required distance clear of her when it began to shift in. Mr Davidson pointed out that Mr Lammas had tried to restrain his mount, however it was clear that by then it was too late and the 'damage had been done' to ZVEZDA MOYA.
Mr Lammas acknowledged that he had not straightened his mount in time to avoid interfering with the horse inside him. He told the Committee that AMPERAGE was a 3 year old colt having its first raceday start, and that he had not 'hunted' the horse up from the start as it was laying in.
Submissions for Penalty:
Mr Coles told the Committee that Mr Lammas had a reasonably good record in regard to breaches of this Rule. He pointed out that Mr Lammas had 2 breaches within the last 12 months which had resulted in periods of suspension of 3 and 4 days respectively. Turning to this incident, Mr Coles said the Stewards felt it was an error of judgement by Mr Lammas and that it could be viewed as being at the lower end of the scale of seriousness. He added that the Stewards felt that Mr Lammas left his attempt to straighten his mount too late by a couple of strides.
At the Committee's request Mr Coles ascertained that Mr Lammas had ridden at Industry day race meetings in the Central Districts twice over the preceding 3 months as well as some Saturday meetings. He added that the Stewards would view Mr Lammas as a North Island rider.
Mr Lammas told the Committee that had a confirmed ride at the Wanganui meeting on 5 September and would like any suspension to start after that race meeting.
Reasons for Penalty:
The Committee took into account the submissions of the parties and independently viewed the films of the incident.
In our view, while the carelessness by Mr Lammas was at the low end of the scale, we believed the effect of that carelessness on Ms Schwerin was low-mid range. We took into account Mr Lammas' admission of the breach, and agreed that his record for a relatively busy rider was reasonably good.
The JCA Penalty Guide provides for a starting point of a 5 day suspension for a breach of this Rule. Taking into account the mitigating factors above we believe an appropriate penalty in this case would be a 4 day suspension.
This Committee accepted that Mr Lammas could be treated as a North Island rider.
