Following Race 10 the Informant filed an information alleging a breach by S Saad, in that as the rider of Princess Road, he allowed his mount to shift outwards near the 50 meter mark crowding Katies’s Dan (R Novall) and causing that horse to be severely checked.

Mr Saad admitted the breach. A protest in respect of the alleged interference had earlier resulted in the relegation of Princess Road from fourth placing to fifth placing.

Mr Oatham demonstrated the video films and showed how Mr Saad had angled his mount out some three widths, using his whip, and had made contact with Katies Dan – the actions causing interference to Katie’s Dan and in turn to another horse on the outer.

Decision and Penalty:

Accepting the Defendant’s admission of the breach the Committee took heed of the Informant’s submissions that the interference was at the highest level of careless riding, and that the Defendant had continued to use his whip even after making contact with the outside horse. He further maintained that the consequences of the interference could have been far more severe.

The Informant advised that whilst the Defendant had a “reasonable record” the circumstances of the breach warranted a suspension of 6-8 days. The Defendant made no submissions as to penalty.

The Committee found that the riding breach had reached a high degree of carelessness, and that the consequences could have been more severe. Factors alsotaken into account was the Defendant’s continued use of his whip after making contact with the outside horse, and that the circumstances had resulted in the relegation of his mount.

The Committee imposed a suspension of 8 days, to commence at the end of racing on the 31 May, and to conclude at the end of racing on the 14 June 2008.
