As Mr Cameron admitted the breach we find the charge proved.
Penalty:
We grant Mr Cameron’s request to seek a deferment to his suspension as per Rule 1106(2).
Accordingly, we impose a suspension on Mr Cameron which will commence after racing on 4 July 2015 and conclude after racing on after 10 July 2015 (3 days).
Facts:
Following the running of Race 3, the Whangarei Love It Here 1200, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Oatham, alleged that “shortly after the start M Cameron (SILENCER) allowed his mount to shift in when not sufficiently clear of MALALA (T THORNTON) which was checked.
Mr Cameron acknowledged that he understood the nature of the charge and confirmed his admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Oatham identified the incident using available head and side-on video footage. He advised the Committee that the incident occurred shortly after the start of the race. He said Mr Cameron’s mount (SILENCER) drew barrier 5 and Ms Thornton’s mount (MALALA) drew barrier 4. MALALA jumped away awkwardly and shifted inwards. Mr Cameron rode SILENCER forward with vigour and shifted into the running line of MALALA when no more than between ¾ to 1 length clear. He said as a result MALALA was checked and lost ground.
Mr Cameron told the Committee that his mount did not jump well so he rode forward with vigour. He said that Ms Thornton’s mount jumped in after the start and he thought there was a gap but now realised he mis-judged the situation. He added he was riding the short priced favourite and wanted to put his mount up on the speed.
Mr Cameron also told the Committee that he subsequently spoke to Ms Thornton post race and she confirmed to him that her mount was racing greenly. But he accepts that he crowded MALALA.
Submissions for Penalty:
Mr Oatham submitted that there were mitigating factors in Mr Cameron’s favour. He said that as a result of MALALA jumping inwards, it gave Mr Cameron an illusion there was more room than there actually was. He added that MALALA reacted poorly to the interference but highlighted that MALALA was nevertheless entitled to its rightful line of running. He submitted the level of carelessness was at the low end and Mr Cameron should be given credit for his prompt admission of the breach and his good record. We were advised that Mr Cameron has had 898 rides to date this season and has breached this rule twice previously – on 26/12/14 (4 days) and 05/07/14 (5 days). Of note we were told that the 05/07/15 breach occurred 11.5 months ago and will reset after a period of 12 months – this will occur next week. Mr Oatham submitted a 4 day suspension would be appropriate.
Pursuant to Rule 1106(2), Mr Cameron sought a 7 day deferment to any proposed suspension due having riding commitments up to and including 4 July 2015. He also submitted to the Committee that he was a busy rider who rode throughout the country. This was accepted by the Stewards.
Mr Cameron asked the Committee to consider imposing a 3 day suspension and fine so that he could be available to ride at the Ruakaka meeting on 11 July 2015. In support of this he said he was a very busy rider and had an outstanding record. The Committee asked Mr Cameron if he could advance any further compelling reasons for the Committee to give him favourable consideration for a suspension/fine combination. He conceded that there were no reasons other than his very good record.
When asked for their view on a proposed penalty including a suspension / fine, Mr Oatham said the RIU do not support this unless there are exceptional circumstances. On this occasion the Stewards do not believe Mr Cameron’s request to be classified as exceptional circumstances.
Reasons for Penalty:
In determining penalty the Committee has taken into account the submissions of the Informant and Defendant, the Penalty Guidelines for Committees as well as recent penalties for similar breaches. The Committee is mindful of the fact that breaches of similar culpability should, as a general rule attract broadly similar penalties. The Committee has adopted 5 riding days suspension as the starting point.
The Committee notes that it does have the discretion where appropriate to consider suspension and fine combinations.
The Committee has taken into account and had due regard for the overall circumstances of the breach itself as well as the particular circumstances relating to Mr Cameron.
We assess the breach as low end. This is because the inward shift was a one horse width and the incident was exacerbated by MALALA reacting poorly to being checked. We note that Ms Thornton the rider of MALALA reported and the Stewards accepted her horse raced greenly.
We give Mr Cameron credit for his admission of the breach and his very good record. He is the country's busiest rider (898 rides to date this season). We also note one of his two previous breaches will reset next week. We place no weight on Mr Cameron’s submission that he was riding the hot favourite in the race. Whether he is riding the favourite or not, he has an obligation to ensure he is sufficiently clear of other runners when shifting ground.
The Committee did consider Mr Cameron’s request for a suspension / fine combination. In our opinion there were no compelling or exceptional circumstances placed before us to merit a combined penalty in this case. This is not to say that in any future case where appropriate circumstances exist a combined penalty could be favourably considered.
After taking into account all the above, with an emphasis of the mitigating factors, we consider an appropriate penalty is a 3 day suspension.
