RACEDAY JUDICIAL COMMITTEE DECISION

--

Informant:  Mr R Neal, Stipendiary Steward

--

Defendant:  Ms L Satherley

--

Information: 433

--

Meeting:  Whangarei Racing Club

--

Date:  25th August 2010

--

Venue:  Ruakaka

--

Race:  9

--

Rule No:  638(1)(d)

--

Judicial Committee:  B Rowe, Chairman – D Johnstone, Committee Member

--

Plea:  Admitted

--

--

CHARGE(s):

--

Permitted her mount DANNY BOLT to shift inwards passing the 1100 metres when not sufficiently clear of ALL THE BUZZ ridden by Mr M Cameron which was forced inwards causing a check to ALTIVO CHI ridden by Mr P Taylor.

--

--

FACTS:

--

Stipendiary Steward Mr J Oatham showed and interpreted the video film of the incident.  Mr Oatham said Ms Satherley had gradually moved DANNY BOLT inwards which forced ALL THE BUZZ inwards which in turn caused Mr Taylor to check ALTIVO CHI.

--

--

Ms Satherley accepted the evidence of Mr Oatham.  She said she heard yelling and immediately pulled her mount outwards.

--

--

SUBMISSION(s) ON PENALTY:

--

Mr Neal said Ms Satherley had one careless riding breach in the last twelve months, the offending was at the lower end of the scale and Ms Satherley was a North Island rider.

--

--

Ms Satherley accepted the submissions of Mr Neal.

--

--

REASON(s):

--

In fixing penalty the committee takes into account the admission of the breach, the submissions of Mr. Neal and the acceptance of them by Ms Satherley, the good riding record of Ms Satherley and agrees the offending is at the lower end of the scale.

--

--

PENALTY:

--

Balancing the above matters but with emphasis on the relative non seriousness of the breach, Ms Satherley’s riders licence is suspended for four days, commencing at the end of racing today and concluding at the end of racing on the 4th September 2010.
