CHARGE(s):     

Permitted his mount POCKET DIARY to shift inwards near the 800metres when not sufficiently clear of SINGLE CURRENCY ridden by Mr M Hills which was checked.

EVIDENCE:     

Stipendiary Steward Mr J Oatham showed and interpreted the video films of the incident.  He said Mr Bosson permitted POCKET DIARY to move inwards at about the 800metres when racing outside SINGLE CURRENCY and MIGHTY RULER ridden by Mr H Kasim.  He said POCKET DIARY did not have the required one length clear margin between it and SINGLE CURRENCY.  He said Mr Hills had to take hold of SINGLE CURRENCY which lost between one and a half and two lengths.  He said all three horses had been racing tractably. 

Mr Hills confirmed the evidence of Mr Oatham.  He said POCKET DIARY was about three quarters of a length clear of SINGLE CURRENCY when it moved inwards.  He said he had to take a strong hold of his mount. 

Mr Bosson said POCKET DIARY was clear of SINGLE CURRENCY and he believed that horse had trouble getting around the sharp corner. 

REASONS FOR DECISION:         

The committee accepts the evidence of Mr Oatham and Mr Hills.  POCKET DIARY moved inwards when insufficiently clear of SINGLE CURRENCY causing a sharp check to that horse.  There is no evidence that SINGLE CURRENCY moved outwards.

DECISION:

This is a clear cut case.  The charge is proven.

SUBMISSIONS ON PENALTY:

Mr Neal said although Mr Bosson had five careless riding breaches in the last 12 months, the last breach was almost 5 months ago and Mr Bosson had had a significant number of rides in that time.  He said the offending was at the lower end of the scale, it was an error of judgment.  Mr Bosson was a national rider and submitted that a suspension in the vicinity of four days was appropriate. 

Mr Bosson accepted the submissions of Mr Neal.

REASONS:

In fixing penalty the committee takes into account the submissions of Mr Neal, the acceptance of them by Mr Bosson, acknowledges Mr Bosson’s recent good riding record and agrees the offending is at the lower end of the scale.

PENALTY:

Balancing the above matters Mr Bosson’s rider’s licence is suspended for four days, commencing at the end of racing on 28^th August and concluding at the end of racing on the 4^th September 2010.
