Following Race 10 an information was filed pursuant to Rule 632. The informant, Mr J Oatham requested a ruling as to whether POSTAGE (L. Innes) was denied a fair start due to a starting gate malfunction.
Submissions for Decision:
Mr Oatham demonstrated the incident by showing the head on and side on views of the start. He believed they clearly showed the barrier of POSTAGE was slow to open.
Mr Innes said that the films clearly demonstrated that POSTAGE was denied a fair start due to a barrier malfunction.
Reasons for Decision:
The head on video film showed that POSTAGE had to force the barrier open and in doing so was denied a fair start.
