Charge:
Mr Williamson lodged information pursuant to rule 638 (1) (d) from the Whangarei R.C. on the 22nd of June 2011. He alleged that Mr Hutchings near the 100 metres mark allowed his mount BLUZERO to shift in when not sufficiently clear of POSTAGE (L Innes) who was checked and shifted in causing ALDERNEY (M Wenn) also to be checked.
 
Evidence
Mr Oatham demonstrated the video films which showed Mr R Hutchings allowed his mount BLUZERO to shift in at the 100 metres mark when being ridden forward with the whip. This resulted in POSTAGE and ALDERNEY who were racing on his inner being crowded and checked. Also hampered as a result was RED HOT. Mr Oatham submitted that Mr Hutchings did attempt to straighten his mount; however it was too little too late.
 
Mr Hewitson submitted that Mr Hutchings had hit BLUZERO one too many times. He accepted that interference did occur but rated it at the lower end. He said this was Mr Hutchings first careless riding offence in 137 raceday races.
 
Decision
As the breach was admitted we find the charge proved
 
Submissions for penalty
Mr Williamson produced Mr Hutchings’ record which showed no previous breaches of this rule. He said this hearing was held today because the stewards had run out of time at the meeting held at Ruakaka on June 22nd. He submitted the interference was at the low end and Mr Hutchings admitted the breach.
 
Mr Hewitson said Mr Hutchings had no upcoming commitments and would like the suspension to start immediately.  Mr Hewitson when asked by the committee stated that Mr Hutchings only rode in the North Island.
 
Reason For penalty:
The committee carefully considered all evidence and submission presented. Mitigating factors are Mr Hutchings admission of the breach and his excellent record. We rate his level of carelessness at low range.  The aggravating factor is Mr Hutchings carelessness which resulted in interference to 3 horses.
 
Penalty:
Accordingly we impose a suspension on Mr Hutchings commencing after racing on July 2nd 2011 and conclude after racing on July 13th (4 riding days).
