As the breach was admitted we find the charge proved.
Penalty:
Accordingly we suspend Miss Collett from riding in races which is to start after racing on 25 June and conclude after racing on 1 July 2011 (4 days).

Facts:
Following race 2 an information was filed pursuant to rule 638 (1) (d). The informant Mr Williamson alleged that Miss Collett permitted her mount JESSABELLA to shift outwards near the 250 metres when not sufficiently clear of LADY GAGA which was checked.
Submissions for Decision:
Mr Oatham demonstrated the video films and pointed out JESSABELLA racing in a 5 wide position approaching the 250 metres. He submitted Miss A Collett riding JESSABELLA allowed her mount to drift out into the line of LADY GAGA when insufficiently clear. Mr Oatham submitted that Miss Collett moved out 1 to 2 horse widths but admitted the interference to LADY GAGA was accentuated by Mr Innes' inward movement. Mr Oatham also said that JESSABELLA was racing greenly.
Miss Collett said her mount was racing erratically and tended to run away from the whip.
Mr Vance, representing Miss Collett, said that JESSABELLA had run off at it's first trial. He also submitted that LADY GAGA had moved out slightly contributing to the incident. He agreed with Mr Oatham that Mr Innes' mount had moved in making further contribution to the incident.
Submissions for Penalty:
Mr Williamson said Miss Collett had incurred 4 suspensions but because of the mitigating factors already mentioned, submitted any penalty should be at the low end.
Miss Collett said she had commitments up to and including Tauranga on 25 June.
Reasons for Penalty:
The committee considered all submissions and evidence. Mitigating factors include Miss Collett's admission of the breach, her relative inexperience and that her mount was green and racing erratically. However it was clear that Miss Collett continued to ride her mount forward without attempting to straighten. This resulted in a check to Miss Spratt as Miss Collett was not sufficiently clear when moving into her line. After balancing all these facts we find Miss Collett's carelessness is at the low end.
