Accordingly after taking all the above into account we dismiss the protest and the judges placing shall stand. We further order the payment of dividends and stakes as stated.

Facts:

Following race 2 a protest was lodge pursuant to rule 642(1). The informant Mr C Grylls, rider of the 3rd placed horse, VALENCIA’S IMAGE alleged that SHAN STAR placed first by the judge, interfered with his chances in the final straight.
The judges placings were as follows:
13 SHAN STAR FIRST
7 MISS CURIOSITY SECOND
16 VALENCIA’S IMAGE THIRD
9 LUCKY BREAK FOURTH
4 MANNY PACUIAO FIFTH
The official margins were ½ head between 1st and 2nd and 2 lengths between 2nd & 3rd.

Submissions for Decision:

Mr Grylls demonstrated the video films and showed where he was racing in a 3 wide position approaching the 200 metres. He said at that stage he was starting to improve on the outside of MISS CURIOSITY. He stated that there was plenty of room for him to do so but this was extinguished by the inward movement of SHAN STAR (L Innes). Mr Grylls said he lost momentum as a result and was starting to come back in the run to the post.

Mr Moroney confirmed what Mr Grylls had said.

Mr Innes, rider of SHAN STAR, said there was a gap for Mr Grylls to take if he had been travelling well enough. He also said MISS CURIOSITY had come out slightly but was adamant that Mr Grylls had ample time to make up the 2 ¼ length margin in the run to the post. Mr Innes said any inconvenience to Mr Grylls would only have cost him ½ length at the most.

Mr Williamson when asked for his assessment of the incident said that it was evident that VALENCIA’S IMAGE had received interference from SHAN STAR when that horse had moved in at the 200 metres. However because of the 2 ¼ margin at the post between 1st and 3rd Mr Williamson said he had considerable doubt that VALENCIA’S IMAGE would have beaten SHAN STAR if interference had not occurred. For that reason he would not support the protest.

Mr Grylls, when given the opportunity to sum up, said he had nothing further to add.

Reasons for Decision:

The committee considered all evidence and reviewed the video footage. We are satisfied that Mr Grylls did have to check his mount through the inward mount of the winner SHAN STAR. However the critical element to consider is the 2 ¼ length margin at the post. The films clearly showed VALENCIA’S IMAGE was not making ground on SHAN STAR after the interference occurred. Taking the margin of 2 ¼ lengths between the 2 horses the committee is not satisfied that VALENCIA’S IMAGE would have beaten SHAN STAR if interference had not occurred.
