As the breach was admitted we find the charge proved.

Accordingly we impose a suspension on Mr Innes from riding in races which is to start after racing on 25 June and conclude after racing on 2 July 2011 (5 days).

Facts:

Following race 2 an information was filed pursuant to rule 638 (1) (d).  The informant Mr Williamson alleged that Mr L Innes permitted his mount SHANSTAR to shift inwards near the 100 metres when not sufficiently clear of VALENCIA'S IMAGE (C Grylls) which was checked.

Submissions for Decision:

Mr Oatham demonstrated the video films and pointed out Mr Innes riding SHANSTAR racing in a position 2 outside VALENCIA'S IMAGE nearing the 100 metres.  Mr Oatham submitted that Mr Innes then allowed his mount to move in when insufficeintly clear of VALENCIA'S IMAGE which caused its rider Mr C Grylls to take a strong hold for several strides.  Mr Oatham said Mr Innes continued to ride forward without attempting to straighten his mount.

Mr Innes submitted that Mr Grylls only had to take hold for 2 strides and believed his inward movement was gradual and only cost Mr Grylls approximately half a length.  He also submitted his horse was a first starter and raced in side winkers due to wayward tendencies.

Submissions for Penalty:

Mr Williamson said Mr Innes had incurred 3 suspensions in the last 12 months.  However he said in this case Mr Grylls was placed in an awkward position for several strides.  Mr Williamson submitted any penalty should be towards the low end.

Mr Innes submitted that he had commitments up to and including the Tauranga meeting on 25 June and that he was a national rider.

Reasons for Penalty:

The committee carefully considered all evidence and submissions before imposing an appropriate penalty.  It was clearly evident on the video films that Mr Innes did allow his mount SHANSTAR to move in when insufficiently clear of VALENCIA'S IMAGE.  This inward movement carried on for several strides with Mr Innes riding forward with the whip and making no attempt to straighten.  This resulted in quite a severe check to Mr Grylls who had to take a strong hold of his mount and lose considerable momentum.  These aggravating factors mean the committee would normally impose a 6 day suspension, an increase of 1 day from the starting point of 5 days.  However mitigaitng factors include Mr Innes' good record and his admission of the breach.  Therefore after taking all the above factors into account we determine an appropriate penalty is one of 5 days.  It is worth noting that Mr Grylls, finishing 3rd behind Mr Innes' mount who won the race, lodged a protest due to the check he received.  However this was subsequently dismissed.
